RE: The tariff classification of steel tubes from China.

Dear Mr. Clark:

In your letter dated June 17, 2010, on behalf of Advanced Control Technologies, Inc., you requested a tariff classification ruling.

The products you plan to import are steel tubes meeting ASTM A519, the Standard Specification for Seamless Carbon and Alloy Mechanical tubing. Round and cold-rolled/cold-drawn, you state that the carbon steel tubes will meet the chemical requirements of grade designations 1010, 1020 and 1026, and the alloy tubes will meet 4130, 4140 and 52100. These tubes can be used in various mechanical applications such as motor vehicle parts, agricultural equipment parts and conveyor rollers.

The applicable subheading for the carbon steel tubes will be 7304.31.6050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tubes, pipes and hollow profiles, seamless, of iron (other than cast iron) or steel, other of circular cross section, of iron or nonalloy steel, cold-drawn or cold-rolled (cold-reduced), other, other. The rate of duty will be free. The applicable subheading for the alloy steel tubes will be 7304.51.5060 , Harmonized Tariff Schedule of the United States (HTSUS), which provides for tubes, pipes and hollow profiles, seamless, of iron (other than cast iron) or steel, other of circular cross section, of other alloy steel, cold-drawn or cold-rolled (cold-reduced), other, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
